Litigation Practice
Brennan, Dain, Le Ray, Wiest, Torpy & Garner, P.C.'s Litigation Practice represents clients, including real estate developers and property owners, as well as other businesses and individuals, in a broad array of disputes including active litigation, appeals, arbitration, and mediation. Our litigators regularly appear in the Land Court, in Superior and District courts throughout the Commonwealth, in the Massachusetts Appeals Court and Supreme Judicial Court, and in the United States District Court for the District of Massachusetts. Members of the firm's Litigation Practice also counsel clients on dispute and liability resolution, avoidance, and minimization.
The firm's Litigation Practice is widely recognized as a regional leader in real estate and land use-related litigation. Within these areas of practice, the firm has a particular specialty in zoning and permitting litigation, with a long track record of successfully moving to dismiss on standing grounds challenges to permits secured for clients. - owners and possessors in adverse possession claims,

The firm's Litigation Practice is not limited to real estate and land use related matters. We also have a robust commercial litigation practice. We regularly handle closely-held corporate disputes, including breach of fiduciary duty claims; breach of contract claims; fraud and Chapter 93A allegations; insurance coverage disputes, and a variety of other disputes that arise in the corporate context.
